Guaranteed Installment Agreement Lawyers

The IRS provides rules and procedures to obtain a guaranteed installment agreement. This allows taxpayers to make a plan for the payment of overdue federal tax liabilities they are unable to pay in a single lump sum.

Qualifying for a Guaranteed Installment Agreement

The IRS is required to accept a payment over time for all past tax balances under $10,000. The minimum monthly payment the IRS will accept is the balance due with interest and penalties divided over 36 months. All guaranteed requests must comply with the following terms:

  1. The previous five years of returns have been filed and paid on time
  2. All tax returns are filed
  3. Monthly payments will pay the balance within 36 months
  4. No Installment Agreements in the past five years
  5. File and pay on time for future tax years

These plans require no financial disclosure and will not result in the filing of a tax lien or reporting on your credit score. Future refunds will be taken to pay the unpaid tax.
